ARTIGOS DAS SISAS NOVAMENTE EMENDADOS

per mandado Delrei nosso senhor. Foi impresso em a mui nobre & sempre leal cidade de Lixboa em casa de Manuel Ioam. Anno. M.D.LXVI. [1566]. Com privilegio real.

De 30x20 cm. Com [ii], xxxvii, [i em br.], 7, [i] fólios. Encadernação da época em pergaminho flexível com vestígios de um dos atilhos.

Escudo das armas reais de Portugal ao centro da folha de rosto, com um grifo no timbre, elmo e paquife, com ramagens que rodeiam o escudo.

Impressão a duas colunas em caracteres góticos, com excepção do privilégio, dos títulos e do índice, que são em caracteres redondos. Está ornamentada com belas iniciais decoradas de apreciável dimensão, nas folhas preliminares e mais pequenas ao longo de todo o texto e nas letras do índice.

Exemplar com manchas e vincos nas pastas da encadernação, assinatura de posse coeva na folha de rosto e pequena mancha no pé da mesma. Tem também uma mancha nos cantos inferiores de todas as folhas com pequenas perdas de papel nas primeiras e nas últimas. Apresenta sublinhados e anotações marginais em tinta coeva, sendo uma delas, à cabeça do fólio 7, muito extensa. A folha 30 é de menores dimensões.

As duas folhas preliminares incluem o Privilégio real, de 28 de Novembro de 1564, assinado pelo Cardeal D. Henrique regente do reino, no verso da folha de rosto, o Prólogo em nome de D. Sebastião, na frente da segunda folha, que tem o verso em branco. Os sete fólios finais incluem o índice e o ultimo, sem numeração, tem as erratas.

Esta é a 3.ª edição da obra, tendo a 1.ª sido publicada em 1512. A 2.ª edição viu a luz com o seguinte título ARTIGOS DAS SIZAS imprimidos por mandado d’Elrei D. João III. Lisboa, por German Galharde 1542. Posteriormente foram publicadas as seguintes edições: Lisboa, 1678, Lisboa, 1702, Lisboa, 1816.

Muito raro livro quinhentista e obra muito importante para o estudo da evolução do sistema fiscal em Portugal e das implicações sociais dos impostos.

As Sisas eram um imposto indirecto que recaía sobre as mercadorias que entravam em contrato de compra e venda e troca. Aparecendo inicialmente como imposto municipal extraordinário para socorrer a despesas extraordinárias. Depressa se transformou em imposto régio também provisório, e a partir do reinado de D. João I com carácter permanente e geral, de que nem o Rei ou a Raínha estavam isentos. A importância deste imposto pode verificar-se logo no reinado de D. João I, em que o total arrecadado por aquele imposto representou cerca de três quartos de todas as rendas da coroa. Foi, por isso, várias vezes regulamentado e alterado para melhor satisfazer as necessidades dos vários momentos históricos (Dic. Hist. Port., VI, p. 1)

As Sizas foram estudadas por Teixeira de Magalhães, na obra: A Siza e o Imposto sobre as Sucessões e Doações, Coimbra Editora, 1935, pág. 13, na qual nos diz:

«O imposto da siza é antiquíssimo entre nós. Diz Frei Joaquim de Santa Rosa de Viterbo, no seu Elucidário, que o tributo da siza introduziu em Castela El-Rei Dom Sancho no ano de 1285, e daí passou a Portugal. E tal desenvolvimento teve este tributo que para ele houve o seu «Regimento» com os desenvolvidos «Artigos das Sizas», que continham as normas reguladoras deste imposto, assaz variado e da maior complexidade. É certo que abrangendo as transmissões por título oneroso, recaía tanto sobre a propriedade imóvel como sobre a mobiliária — móveis e semoventes — e sem nenhuma uniformidade: a taxa variava segundo os bens sobre que incidia e ainda segundo as terras e a naturalidade do comprador e do vendedor. Era assim um dos grandes rendimentos do Estado, e muito maior seria se o seu produto entrasse inteira e integralmente no tesouro público. O grande reformador Mousinho da Silveira, pelo decreto de 19 de Abril de 1832, artigo 1.º, determinou que «desde o 1.º de Janeiro de 1833, se não paga sisa alguma por nenhum título e sobre nenhum contrato, senão de vendas e trocas de bens de raiz».

Printed in two columns in Gothic characters, except for the privilege, the titles and the index, which are in round characters. It is adorned with beautiful decorated capital letters of appreciable size on the preliminary leaves and smaller ones throughout and in the index letters.

Copy with stains and creases on the binding covers, coeval ownership signature on the title page and small stain at the foot of the title page. There is also a stain on the lower corners of all folios with minor paper loss on the first and last folios. There are marginal underlining and annotations in contemporary ink, one of which, at the head of folio 7, is very extensive. Folio 30 is smaller.

The two preliminary leaves include the Royal Privilege, of 28 November 1564, signed by Cardinal Henrique, regent of the realm, on the verso of the title page, the Prologue in the name of King Dom Sebastião, on the front of the second leaf, which has a blank verso. The final seven folios include the index and the last one, unnumbered, has the errata.

This is the 3rd edition of the work, the 1st having been published in 1512. The 2nd edition came out with the following title ARTIGOS DAS SIZAS imprimidos por mandado d’Elrei D. João III. Lisboa, por German Galharde 1542. The following editions were subsequently published: Lisbon, 1566, Lisbon, 1678, Lisbon, 1702, Lisbon, 1816.

Very rare and important for the study of the evolution of the tax system in Portugal and the social implications of taxes.

”Sisas” were an indirect tax levied on goods that entered into a contract of sale and exchange. It initially appeared as an extraordinary municipal tax to help cover extraordinary expenses. It soon became a royal tax, also provisional, and from the reign of King João I it became a permanent and general tax, from which neither the King nor the Queen were exempt. The importance of this tax can already be seen during the reign of King João I, when the total amount collected from this tax represented about three quarters of all the crown"s revenues. It was, therefore, regulated and changed several times to better meet the needs of the various historical moments (Dic. Hist. Port., VI, p. 1)

”Sizas” were studied by Teixeira de Magalhães in his work: A Siza e o Imposto sobre as Sucessões e Doações, Coimbra Editora, 1935, p. 13, in which he tells us:

'The “siza” is very old tax among us. Friar Joaquim de Santa Rosa de Viterbo says, in his Elucidário, that the “siza” tax was introduced in Castile by the King Dom Sancho in the year 1285, and from there it passed to Portugal. And such was the development of this tax that it had its 'Regimento' with the developed 'Artigos das Sizas', which contained the rules regulating this tax, quite varied and of the greatest complexity. It is true that it covered transfers for valuable consideration and was levied on both immovable and movable property without any uniformity: the rate varied according to the goods on which it was levied and also according to the land and nationality of the buyer and seller. It was thus one of the great revenues of the State, and much greater would be if its proceeds went entirely into the public treasury. The great reformer Mousinho da Silveira, by the decree of April 19th 1832, article 1, determined that 'since January 1st 1833, no “sisa” shall be paid for any title or on any contract, except for sales and exchanges of property'.
