Rara 1ª edição com carácter nacional e oficial.

Trata-se da primeira constituição que esteve em vigor em Portugal, com grande interesse para o estudo da evolução das instituições políticas no nosso país. A segunda edição desta Constituição saiu em 1836. 

Tem junto a lista dos deputados que a votaram, com indicação dos círculos que representavam, e o Decreto de 26 de Setembro de 1822, que determinava que a divulgação do articulado constitucional seria feita exclusivamente em edições nacionais e oficiais sendo proibidas todas as outras.

A constituição resultou dos trabalhos das Cortes Gerais Extraordinárias e Constituintes da nação Portuguesa de 1821-1822, eleitas por um grupo muito restrito de cidadãos - a primeira experiência parlamentar em Portugal, resultado da revolução liberal de 24 de Agosto de 1820 no Porto.

As Cortes Constituintes, cuja função principal, como o próprio nome indica, era elaborar uma Constituição, iniciaram as sessões em Janeiro de 1821 e deram os seus trabalhos por encerrados após o juramento solene da Constituição pelo rei D. João VI em Outubro de 1822, juramento que foi recusado pela rainha Carlota Joaquina e por outras figuras como o Cardeal Patriarca de Lisboa, D. Carlos da Cunha e Meneses.

A sua vigência foi curta (1822-23 e 1836-38) e acidentada, devido ao extremismo de algumas das suas normas, tendo sido substituída pela Carta Constitucional de 1826. Efectivamente, os deputados constituintes das Cortes de 1822 basearam-se no texto da Constituição Espanhola de Cádiz, de 1812, que por sua vez reproduzia a constituição francesa do período do Terror de 1791 e a posterior de 1795, não tendo em conta a realidade do país, a sensibilidade e cultura das populações nem a situação económica e social depois das Invasões Francesas.

A rare national and official first edition.

This is the first constitution of Portugal, with high interest for the study of the evolution of the Portuguese political institutions. The second edition of this Constitution was edited in 1836. 

It includes the list of the members of parliament who voted, together with their constituencies. Also includes the Decree-Law dated September 26, 1822, which established that the information of the constitution’s contents could only be made in national and official editions, all other forms being prohibited.

The constitution was the result of the work carried out at the “Cortes Gerais Extraordinárias e Constituintes” of Portugal between 1821and 1822, elected by a restricted group of citizens – the first parliamentary experience in Portugal, resulting from the liberal revolution, which started in Oporto on August 24, 1820.

The works started in January 1821 and ended in October 1822, when King D. João VI took the oath to the Constitution. The Queen Carlota Joaquina and other important figures at the time, like Lisbon’s Cardinal D. Carlos da Cunha e Meneses, refused to take the oath.

The Constitution had a short and bumpy life (1822-23 e 1836-38), due to the extremism of some of its norms, having been replaced in 1826 by the “Constitutional Charter”. In fact, the members of the Courts based the text on the 1812 Cádiz Spanish Constitution, which in turn reproduced the French Constitution in force during the 1791 reign of Terror, not taking into account the reality of Portugal, the sensibility and culture of the Portuguese people, nor the economic and social situation of the country after the French Invasions.
